There can be no substitutions for these services. Credits cannot be gifted and can only be used by Member. Membership discounts cannot be combined with other promotions. Memberships are non-refundable and non-transferable.
Appointments & Late Policy
Our standard 24-hour cancellation policy applies to all members. If you miss, cancel, or change your appointment outside this designated time, you will be charged 50% of the total of your scheduled services or $25.00 usd Booking Fee not returnable. Late arrivals may result in a shortened appointment or rescheduling (charges may apply). To cancel or change your appointment, please call the spa directly.
Cancellation
You can cancel your membership at any time. To cancel, you must visit a Magic Body Sculpt Office location to fill out and sign the Membership Cancellation Form. Cancellation requests cannot be made over the phone. Cancellation requests are not retroactive. There are no refunds and membership fees cannot be prorated if you cancel before your month is over. You may use any accrued credits for a period of up to 30 days after your final membership payment has been processed.
Faulty Payments
Memberships must be purchased with a valid credit/debit card only. No other form of payment is accepted. Memberships cannot be paid using a gift card. Magic Body Sculpt LLC must be notified of any change in billing address on file, contact and credit card information. If a credit card is declined or automatic payment does not go through, Member must call Magic Body Sculpt Office within 7 days to provide a new form of payment. If Member fails to reach out to the spa within 7 days, Member forfeits all stockpiled credits and discounts and membership will be suspended until a valid form of payment is provided. No refunds will be given for any remaining unused credits or discounts.
Freeze Policy
Accounts can be frozen for up to 3 months once in a 12-month period. Members must be current with payments and make a minimum of 3 consecutive payments in order to be eligible to freeze. Freeze will begin immediately after the most recent successful billing cycle, not the freeze date. During a freeze, stockpiled credits and discounts are retained until unfreezing. Credits and discounts can't be used while Membership is frozen.
Arbitration, Class Action Waiver & Indemnification
I acknowledge that the exclusive method for resolving any controversy, dispute, or claim arising out of or with respect to my Magic Body Sculpt Monthly Membership Program, including the construction and scope of this agreement, shall be by Binding Arbitration. Such arbitration shall be before and in accordance with the rules and regulations of the American Arbitration Association. Any arbitration shall be held in Las Vegas, Nevada, and the parties hereby waive any objections that they may have based on improper venue or foreign non conveniens. The Arbitrator or Arbitrators shall apply the laws of the State of Nevada, without regard to the conflicts of law principles of each state.
Member and Magic Body Sculpt LLC agree to bring any dispute against the other party in our respective individual capacities and not as a plaintiff or class member in any purported class, representative proceeding or as an association. In addition, we each agree that disputes shall be arbitrated only on an individual basis and not in a class, consolidated or representative action. THE ARBITRATOR DOES NOT HAVE THE POWER TO VARY THESE PROVISIONS.
Member and Magic Body Sculpt LLC agree to waive any right to a trial by jury. Notwithstanding anything to the contrary in this Agreement, either party may bring suit in court seeking an injunction or other equitable relief arising out of or relating to claims that the other party’s conduct may cause the other irreparable injury.
In the event Magic Body Sculpt LLC is the prevailing party in any Dispute, subject to any exceptions, Member shall pay Magic Body Sculpt LLC all reasonable attorneys’ fees and costs incurred by Magic Body Sculpt LLC in connection with any Dispute.
To the extent allowed under applicable law, Member agrees to defend, indemnify and hold Magic Body Sculpt LLC, its affiliated and related entities, and any of its respective officers, directors, agents and employees, harmless from and against any claims, lawsuits, investigations, penalties, damages, losses or expenses (including but not limited to reasonable attorneys’ fees and costs) arising out of or relating to any breach or alleged breach by Member of this Agreement, or the representations and warranties made in this Agreement.
Terms & Conditions
I acknowledge that I am signing up for a Magic Body Sculpt LLC Monthly Membership Program. Membership fees of $29.99 USD plus any applicable taxes will be due upon day of signup and will automatically resume on a month-to-month basis for 6 Months unless membership is terminated in accordance with this agreement. Monthly dues and/or renewal fees will be withdrawn on or after the same day of each month. Magic Body Sculpt LLC reserves the right to change certain terms and conditions, including prices from time to time, with no less than thirty (30) days prior to the effective date of the new terms. By signing below, I authorize Magic Body Sculpt LLC to charge the account I have specified. I understand that Magic Body Sculpt LLC may continue to charge my account or cancel my membership in accordance with the terms and conditions of this agreement. We agree to sell, and you agree to purchase the membership, goods and services described herein. You agreed to pay us for the membership, goods and services according to your plan selection and terms above. Your signature below indicates your agreement to be bound by the terms, conditions, rules and regulations of this agreement. All the terms and conditions in this agreement, as well as those contained in the "terms and conditions" section on our website, are a part of this agreement. Terms, Cancellations & Fees:
I Acknowledge that I am signing up for a Magic Body Sculpt LLC 6 Months Membership Program. This program cannot be cancelled. Your membership dues of $29.99 USD Monthly plus any applicable taxes will be due on day of signup and then due on or after the same date of each 6 Months hereafter until your membership is terminated in accordance with this agreement. You agree to pay us for the membership, goods and services according to your plan selection and terms above. Your payment for these services indicates your agreement to be bound by the terms, conditions, rules and regulations of this agreement. All of the terms and conditions in this agreement, as well as those contained in the "terms and conditions" section on our website, are a part of this agreement.
